Image Use Licenses
STANDARD USE AGREEMENT FOR COMMERCIAL IMAGES
A Commercial Photographer is entitled to charge for his time AND the licencing of his images. On the basis that copyright remains at all times with the Photographer the use of any image by the client requires a specific licence covering the use of that image i.e. how it is used, for how long it is used and where in the world it is used.
Instead of charging an hourly rate and then charging extra for image
use, (which can be expensive) I have allowed a full range of uses as
STANDARD within my hourly rate. My hourly rate provides you with a
diverse licence at a known cost, not a seemingly attractive quote with
a number of "if you want this then it's extra, and if you want that,
it's also extra" clauses. If you are obtaining quotes from several
other sources make sure you know what the terms of use that quote is
providing.
In essence the only time you will require anything other than my
STANDARD USE licence is if you want to use an image for the following...
* on the front cover of a publication
* International Usage
* Full Page images (web or print)
* Print runs exceeding 25,000
* Use of an image beyond 24 months
(The above list is not an exhaustive one, but is accurate enough for
illustration purposes, and will cover most scenarios)
The costs below in orange represent accurately industry standard image
licence fees for that particular use, and illustrate how expensive
image licencing can be on a single image use basis. Costs are per image

Use of an image for an internal newsletter, 1/8 page size, UK use,
print run of up to 10, 000, for 1 month only will cost around £80
Use of an image for promotional brochures, 1/8 page size, UK use, print
run of up to 1000, for 1 month only will cost around £135
Use of an image as a Corporate Screensaver for 6 months will cost
around £190
To licence even 10 images at the lowest end of the image use range
would be prohibitive. However my STANDARD USE licence a provides you
with a diverse licence for all 20 images which will cover most usages.
This simplifies the entire licence process, for you and for me, which
at times can become more complicated than it really needs to be.
All of the uses below are inlcuded in the Standard Use Hourly Rate...
Image Use
Copyright remains with Bryn Gerard at all times and is enshrined
in my Term & Conditions.
Upon payment of the agreed sum, ownership of the images (but NOT
copyright) will pass to the client. The licence will be either STANDARD
USE or ENHANCED USE depending on the quotation. The client cannot use
the images beyond the terms and conditions of the licence. If the use
of any image exceeds the licence in any way then a sum equivalent to 3
times the cost of the actual usage will become payable.
Number of Images provided
Any quotation for Standard Use will be provided on the basis of up to
20 images being supplied. You will be able to view and download low
resolution watermarked Comps of all images. Images will be viewable in
a personal password protected gallery, where you can choose your
images. I will at my discretion provide more images should the I feel
it is appropriate.
Web Use
All Standard Use quotations allow for image use on any web page
including main Home page, index page or main site splash page.
ENHANCED USE AGREEMENT FOR COMMERCIAL IMAGES
In line with my simplified licencing areement, images that require an ENHANCED USE agreement will attract a slight premium to be paid but only for the images that require the ENHANCED USE.For example, if you require 17 images in total, (12 that require a STANDARD USE licence and 5 that require an ENHANCED USE licence) the standard use is dealt with within my hourly rate. The 5 images which require an ENHANCED USE licence are simply charged additionally at a flat rate of £30 per image.

Web Use
All Enhanced Use quotations allow for image use on any webpage including the Home page, index page and main site splash page. The size of the screen image has no restrictions. The same image may appear on several different pages.
Geographical Use
All Enhanced Use quotations allow for International image use.
Image Size (Non Web)
All Enhanced Use quotations allow for full page image use.
Image Placement
All Enhanced Use quotations allow for image use on any page of any publication, including Front Cover and rear cover use.
Print Runs
All Enhanced Use quotations allow for image use in publications which exceed print runs of 25,000.
Length of use
All Enhanced Use quotations allow for image use up to 36 months in duration. Use of an image in a publication, any printed material or web page which exceeds 36 months in duration will require an specific individual quote. The licence period starts as soon as full payment has been made by the client.
Restrictions
STANDARD USE and ENHANCED USE licence agreements ARE NOT transferable to any third parties. Any licence granted is granted solely to "the client" for the purposes noted on the quotation and invoice. Reproduction rights are granted by way of a licence and DO NOT imply or confer any rights to Copyright.
